Welcome to HOMEZY THAILAND, a digital platform for advertising real estate for rent and sale throughout Thailand. These Terms and Conditions apply to all individuals and entities—including property owners, real estate professionals, brokers, agents, developers, and authorized representatives—who register an account to submit property listings on the HOMEZY THAILAND website (the “Website”).

By registering as a Lister and using our platform, you agree to comply with these Terms, our Privacy Policy, and all applicable laws and regulations of the Kingdom of Thailand. If you do not agree, you may not use our services.

1. Eligibility and Account Registration

1.1. You must be: • At least 20 years old;
• A Thai national or legally operating in Thailand;
• A lawful property owner or a duly authorized agent, representative, or developer with written permission to list the property;
• Able to provide all required identification, licenses, and documents upon request.

1.2 You are responsible for ensuring the accuracy of your registration information. Providing false, misleading, or fraudulent information may result in immediate suspension or termination of your account and potential legal action.

2. Verification and Compliance

2.1. We reserve the right to verify your identity, licenses, and ownership or listing authorization before approving your account or listings.
2.2. You must comply with all relevant Thai laws, including but not limited to:
• The Civil and Commercial Code
• The Land Code
• The Condominium Act
• The Consumer Protection Act
• The PDPA (Personal Data Protection Act B.E. 2562)
• Real Estate Agent and Broker Licensing Regulations (where applicable)
2.3 You agree to cooperate with HOMEZY THAILAND in the verification process, including providing documents such as:
• ID card or passport
• Property title deeds (Chanote)
• Sales authorization letters
• Company registration documents (if listing as a business)

3. Property Listings

3.1. You are solely responsible for the accuracy, legality, and truthfulness of the information in your listings, including:
• Property details (location, size, condition, title, ownership)
• Pricing and payment terms
• Availability status
• Images, videos, and descriptions
3.2. You must not:
• List properties without valid authority or ownership
• Use misleading images or false pricing to attract attention
• Include illegal terms or discriminatory language
• Post duplicate or spam listings
• Misrepresent your status as an agent, owner, or representative
3.3 All listings must be current and accurate. You are required to update or remove listings that are no longer available.

4. Conduct and Responsibilities

You agree to:
• Interact with potential buyers/renters professionally and ethically
• Respond to inquiries in a timely and honest manner
• Comply with fair housing and anti-discrimination laws
• Use the platform only for legitimate real estate business
• Not solicit users outside the platform with false promises or scams
• Refrain from pressuring or misleading customers into transactions

5. Prohibited Activities

• List fake properties or bait-and-switch ads
• Impersonate another individual or business
• Collect personal information of users without consent
• Post listings for illegal or unlicensed developments
• Attempt to bypass HOMEZY THAILAND’s communication tools or payment models (if applicable)
• Use HOMEZY THAILAND for any unlawful or deceptive purpose

Any breach of this clause will result in immediate suspension or permanent banning and may be reported to relevant Thai authorities.

6. Fees and Subscription Packages

6.1 By registering as a lister, you agree to pay all applicable fees associated with the subscription package you select on the Website. Subscription plans may include different levels of service, listing limits, promotional features, and durations, as described at the time of purchase.
6.2. All fees are clearly displayed prior to confirmation of the selected package. By proceeding with payment, you acknowledge and accept the terms of that package, including any renewal conditions where applicable.
6.3. Payments must be made in full and in advance via the approved payment methods provided on the Website. HOMEZY THAILAND reserves the right to suspend or terminate access to listing services in the event of non-payment or failed transactions.
6.4. Subscription fees are non-refundable except where required by law or explicitly stated otherwise in writing by HOMEZY THAILAND.
6.5. HOMEZY THAILAND does not currently act as a financial intermediary or receive commission from rental or sale transactions unless separately agreed to in writing under a distinct service agreemen

7.Content Ownership and Rights

7.1. You retain ownership of your listing content, but by posting it on our platform, you grant HOMEZY THAILAND a non-exclusive, royalty-free, worldwide license to use, reproduce, modify, and display your listings for marketing, search, and promotion.
7.2. You confirm that all content you upload (text, images, videos) is either owned by you or you have obtained all necessary rights and permissions.

8. Suspension and Termination

8.1. We reserve the right to suspend, restrict, or terminate your account without prior notice if:
• You breach these Terms;
• You post fraudulent or illegal listings;
• You mislead users or engage in unethical conduct;
• You violate Thai laws or regulations.

8.2. In serious cases, HOMEZY THAILAND may report your conduct to the Consumer Protection Board, Real Estate Licensing Authorities, or law enforcement.

9. Limitation of Liability

To the fullest extent permitted by law:
• HOMEZY THAILAND is a neutral listing platform and is not a party to any transaction between agents and users.
• We do not guarantee the success of your listings or that inquiries will lead to transactions.
• We are not liable for any disputes, losses, or damages arising from your interactions with users, or for any claims based on your representations, listings, or agreements.

10. Indemnity

You agree to indemnify and hold harmless HOMEZY THAILAND, its directors, employees, and partners, from any claims, damages, losses, or liabilities arising from: • Your misuse of the platform;
• False or misleading listings;
• Violations of law or third-party rights;
• Disputes with users or authorities regarding your listings or conduct.

11. Data Privacy

All personal data collected is handled in accordance with Thailand’s PDPA. You agree to handle user information responsibly and only for the purpose of responding to inquiries. Any misuse or unauthorized sharing of user data is strictly prohibited and may result in legal consequences.

12. Changes to Terms

We may update these Terms at any time. Changes will be communicated via the platform or email. Continued use of our services after such updates constitutes your acceptance of the new terms.

13. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the Kingdom of Thailand. Any disputes arising under or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of Thailand.
